1. Introduction
Welcome to GardenPathTrail ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at gardenpathtrail.sbs (the "Service") operated by GardenPathTrail.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
GardenPathTrail offers a range of top-tier yacht charter services including but not limited to:
- Yacht hire for the day
- Evening yacht journeys
- Business retreats
- Exclusive celebrations
- Prolonged yacht charters
All services are subject to change based on availability and weather conditions. We may alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you must:
- Be of minimum age 18 years
- Submit accurate and comprehensive details
- Remit the necessary deposit as indicated in your booking confirmation
- Consent to these Terms & Conditions
3.2 Confirmation
We will confirm your reservation only after we have received the payment and sent you a written affirmation. We maintain the right to refuse service at our sole decision.
3.3 Availability
Our charters are dependent on boat availability and favorable weather conditions. We strive to accommodate your preferred timing and dates wherever feasible.
4. Payment Terms
4.1 Pricing
All indicated fees are in € and incorporate all applicable taxes unless stated otherwise. Rates may be modified without prior notice.
4.2 Payment Schedule
- Initial Payment: 50% of the total cost of charter required at time of booking
- Remaining Balance: Payable 48 hours prior to the charter departure
- Extra charges (if any): Payable at the end of the charter
4.3 Payment Methods
We take various forms of payment, including major credit cards, wire transfers, and certified cheques. All payments are processed using encrypted, secure methods.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- A full refund minus processing fees is granted for cancellations made more than 72 hours before departure
- A 50% refund is available for cancellations made between 24-72 hours before departure
- Cancellations made less than 24 hours before departure will not be refunded
5.2 Weather Cancellations
In the case that our captain concludes the weather conditions are not safe, we will propose to:
- Rebook your charter for the next available slot without extra charges
- Issue a full refund should rescheduling prove unattainable
5.3 Mechanical Issues
If there are technical difficulties with the designated vessel, we will endeavor to offer an appropriate replacement. If no alternative vessel is available, we will provide a complete refund.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Obey all instructions given by the crew
- Don safety gear as necessary
- Inform us of any medical conditions that may impact their safety
- Stay within the vessel’s designated areas
6.2 Prohibited Items
The items listed below are not allowed on our vessels:
- Glass containers
- Illegal substances
- Weapons or dangerous items
- Excess non-alcoholic beverages (beyond reasonable quantity for consumption)
- Pets (unless permission is given prior)
6.3 Conduct
Patrons are expected to behave in a courteous and respectful manner. We reserve the right to finish a charter ahead of schedule and without issuing a refund if a patron’s conduct is deemed unsafe or interferes with the experience of other patrons.
7. Liability and Insurance
7.1 Our Liability
We limit our accountability to the sum paid for your charter. We are not responsible for:
- Injuries occurring due to passenger carelessness
- Theft or harm to personal property
- Indirect, incidental, or punitive losses
- Delays caused by weather or other circumstances outside of our control
7.2 Insurance Coverage
We carry comprehensive marine insurance that covers our fleet and operations. Passengers should ensure their own travel and personal insurance.
7.3 Assumption of Risk
By participating in our yacht charters, you recognize that marine activities have inherent risks and you accept responsibility for your personal safety and security.
8. Modifications and Itinerary Changes
We reserve the authority to revise itineraries, routes, or schedules due to weather concerns, safety needs, or operational imperatives. We will make every effort to provide equivalent alternatives where possible.
9. Force Majeure
Our company cannot be held liable for any hold-ups, cancellations, or alterations that result from forces beyond our control, including, but not restricted to:
- Extreme weather phenomena
- Natural calamities
- Governmental directives
- Harbor shutdowns
- Vehicular malfunctions
10. Privacy and Data Protection
Your private data is processed following our Privacy Policy. By utilizing our services, you are consenting to our collection and use of your information as detailed in the Privacy Policy.
11. Intellectual Property
All content situated on our website, encompassing but not exclusive to, text, imagery, logos, and graphics, is secured by copyright and trademark laws. Duplication, distribution, or creation of derivative content without our explicit consent is prohibited.
12. Governing Law
These Terms are dictated by laws of Spain. Legal proceedings shall be resolved in courts within Barcelona, Spain.
13. Changes to Terms
At our discretion, we may alter these Terms at any point. Any changes will be communicated through updates on our website, including a new revision date. Continual utilization of our services equates to agreement to the revised terms.
